【鮮明／台中報導】洪仲丘家屬與律師因手機收訊不良、常斷訊，懷疑遭監聽。電信警察第二中隊中隊長朱瑞生、台中市刑大科技犯罪偵查組長張承瑞均表示，司法單位所進行的合法監聽，被監聽者不會感覺任何異狀，「如果這麼容易被察覺，那就不必監聽了」。
 
張 承瑞說，至於非法竊聽的部分，早期曾有徵信業者勾結電信公司不肖員工，接線至民宅附近的電信箱以竊聽市內電話，現已較為少見，比較常見的是在智慧型手機灌 入監聽軟體。高雄警方去年底就查獲一名男子在網路販賣智慧型手機監聽軟體，每套叫價三萬多元，不但可監聽、定位，連APP、LINE的文字訊息、圖片，第 三方均能透過軟體備份。
 
如何預防手機被植入惡意竊聽軟體？張承瑞說，竊聽程式會耗電、並利 用網路傳輸，因此，如果自己的手機異常耗電（如平時可用一、二天，突然只用半天就沒電）、網路傳輸費用爆增、記憶體容量突然減少或程式運作變慢，就要注意 是否被人灌入不明程式，平時手機最好不要隨便交給他人，維修時應送回原廠或找信得過的業者，不要購買來路不明的山寨機，都是預防的方法。

62歲婦人楊宋阿銀兩年前遭資源回收車撞重傷，無法自理生活，聲請國賠獲賠千餘萬元；而她的家人也以家裡遭受鉅變提國賠，法官查出先前協議賠償對象僅楊婦，判決台中市環保局應賠償楊婦的家人195萬精神慰撫金，成了罕見的「一案兩賠」案例。

承審法官認為被害人楊婦與家人屬個別的權利義務主體，環保局與楊婦協議和解效力，自不及於她的家人。就像甲駕車不慎撞倒機車騎士乙及後載乘客丙，致乙、丙受傷，甲和解賠償乙的效力，並不及於丙，丙自有請求賠償的權利。

據了解，此案在協議階段，楊的家人原期望精神慰撫金能有5百萬元，但結果只有150萬元，才再聲請國賠。

判決書指出，陳姓清潔隊員前年元月24日上午駕駛資源回收車經過神岡區，未經隨車人員指引即貿然倒車，造成騎機車的楊婦閃避不及，撞上資源回收車。

楊婦倒地後頭部外傷併硬腦膜下出血及顱骨骨折，經手術後仍意識不清，無法下床行走及自理生活，需長期醫療照顧，陳姓隊員二審被依業務過失致重傷害等罪判刑10月。

楊婦提起國家賠償，與台中市環保局在去年底達成協議，由環保局賠償楊婦1056萬餘元，包括保險賠償580萬元，以及環保局給付476萬元。

楊婦的丈夫以及3名子女以楊肢體癱瘓需長期醫療照顧，和樂家庭頓蒙陰霾，再次提起國賠，請求給付精神慰撫金。

環保局辯稱，已與楊婦達成協議，並將賠償款項支付給對方，而對方又提起國賠，要求賠償精神慰撫金，顯然違反誠信原則，顯無理由。

不過，法官查出環保局與楊婦協議結果，賠償1056萬餘元，是針對楊婦個人，其中精神慰撫金一項僅列賠150萬元，並未包含楊的家人精神慰撫金，不算違反誠信原則，判決楊的家人勝訴。

資策會產業情報研究所（MIC）表示，2013年大型企業在資安設備方面的投資金額平均為新台幣123.8萬元，較去年成長20.2%。資策會MIC預估，台灣資訊安全設備市場規模在2015年將成長至新台幣363億元，年複合成長率 (CAGR)為14.6%。

MIC調查發現，目前只有12%的大型企業建置資安廠商提供的行動安全解決方案，有60%以上的大型企業，在考量自行攜帶行動裝置 (BYOD)的資安問題下，會增加對行動資安的投資。
