肇事逃逸未定讞先開紅單

我於8月2*發生了一場車禍糾紛，我本人當下查看自己車上並沒有擦撞痕跡，後至摔車的人前詢問有沒有事，對方要求要錢，我跟他說我沒有撞到他，但他堅持說是我撞不讓我離開，我趕時間，當下給他五百元後離開。後被告肇事逃逸，在作筆錄完時警察馬上開一張肇事逃逸罰單，告知說一定要先開單，才能給法院認定，且要我簽名。可是我們雙方都沒證據為啥先開我單，這樣我不就變成犯人且就有肇事逃逸的事實了嗎?(至今依然沒有任何證據可以證明我撞到他)
請問一下警察可以先開我肇事逃逸的罰單嗎?
拜託哪位好心的人可以告訴我該怎辦，我真的沒撞到他，也沒有直接證據
對方有拿驗傷單跟摔車相片，沒證據但一口咬定是我
