統一也都說是上游廠商害他們用到有問題的食品 看來三星有學到真傳XDD http://www.businessweekly.com.tw/KBlogArticle.aspx?ID=5058&pnumber=1 洩密還死不承認，拆穿三星的狡辯話術 在之前一篇文章中，我提到三星的律師將蘋果與 Nokia、Sharp、Phillips、以及 Ericsso n 的機密合約內容洩露給三星的高層，引起了軒然大波。 這有點像計程車公司「台灣大車隊」去 Toyota 大量採購新車；但談價錢之前台灣大車隊 已經知道了 Toyota 賣給泛亞車隊的價錢。那 Toyota 一定沒得談啦，一定被台灣大車隊 吃得死死的。蘋果的協議被三星內部知道造成的損傷也是類似的。 這個紕漏非常大，讓三星不但在商場談判上佔有很大優勢，在訴訟上也盡知對方底牌。蘋 果當然非常不開心，因此要求三星回答以下幾個基本問題： 哪些三星高層知道了這四份合約內容？（Who） 什麼時候知道的？（When） 如何知道的？（How） 知道了之後，拿去作了什麼？（What） 有哪些其他國家的三星律師，在其他案件中也利用了這四份合約內容？ 但事件爆發之後三個月，三星遲遲沒有提出任何答案。蘋果忍無可忍，要求法院介入，用 法院的力量逼迫三星馬上回答上述的問題。北加州法院也同意事態嚴重，要求三星回答上 述問題。 三星安博士的證詞 三星被抓包的關鍵是 Nokia 的證詞。根據 Nokia 的說法，在一場三星跟 Nokia 的談判中 ，三星的談判代表、資深副總 Seungho Ahn 博士（或許可音譯為「安申和博士」？）在跟 Nokia 的談判中，告訴 Nokia 方說：『我知道你跟蘋果之間的合約條件。』甚至安博士 還補了句風涼話：『所有的資訊都會洩露的（All information leaks）』。 因此法院決定介入之後，特別要求安博士必須要提供證詞，說清楚他當時告訴 Nokia 的內 容來源為何。權威的專利部落客 FOSS Patents 獲得三星提供的安博士的證詞，並刊出了 特別有趣的兩段。 在這兩段證詞中，安博士試圖說明他沒做錯事。這份文件很適合說明修辭學的重要性，我 把它翻譯成中文如下，另外穿插註解。粗體都是我加的。 律師的精心傑作－－絕對真實 在分析這兩段話之前，需要先知道兩個背景： 第一，這份安博士的證詞（statement）絕對不是安博士說的話直接記錄，而是有三星的律 師從旁擬稿、審閱、修改，最後才請安博士簽名。事實上照這事件的嚴重程度，我猜這份 證詞有一個團隊在負責，經手過至少 5 個以上的律師才提交給法院的。 第二，在給美國法院的證詞文件中說謊－－也就是作偽證－－的後果非常嚴重。不但說謊 的人會被法院懲戒（重則牢獄之災），明知證人說謊卻不阻止的律師會遭到更嚴重的懲戒 。因此像 Quinn Emanuel 這樣著名的事務所，絕對會盡力確保證詞內陳述的都是事實，否 則再被抓包會是完全的名譽掃地。 但陳述事實（truth）不等於陳述所有的事實（whole truth）。 修辭學的美妙 「22. 我很確定我沒有在 2013 年 6 月 4 日的會議中告訴 Mr. Melin 我從負責三星與蘋 果訴訟的外部律師收到了蘋果/ Nokia 協議內容，因為那不是真的，同時因為這樣說很蠢 。」（按：Mr. Melin 是 Nokia 方談判代表） 「22. I am certain that I did not tell Mr. Melin at the June 4, 2013 meeting that I received Apple/Nokia licensing terms from my outside counsel in the Apple/Samsung case, because it is not true, and because it would be a very foolish thing to say. 第一句話顯然是真實的，但是真實的非常「狹隘」，根本就是極力閃躲。安博士當然不可 能在談判中特別對 Nokia 說：『我從我們的「外部律師」獲得了這份文件』他頂多只會說 ：『我知道你們之間的協議。』因此第一句話雖然真實，卻完全沒有意義。 蘋果指控三星的律師把蘋果的機密文件放在 FTP 上，任由三星的高層下載；因此就算安博 士不是直接從律師手中拿到，而是間接透過其他人獲得，也不影響洩密的嚴重性。 「我擁有一個來自美國的法學院 Santa Clara 大學的法律博士學位（J.D.），而直到十年 前搬回韓國，我都是加州的登記律師。我非常清楚美國訴訟中保護令的重要性。我曾經直 接或間接的監督過上百次專 利訴訟。在幾乎所有的案件中都會有保護令。這些保護令都會 保護在我的經驗中非常機密且敏感的資料。這些資料的保密對我知道的科技公司與對三星 一樣重要。」 "I hold a J.D. from an American law school, Santa Clara University, and until I moved to Korea approximately ten years ago I was a member of the California Bar. I am well aware of the importance of protective orders in United States litigation. I have been responsible directly or indirectly for the supervision of hundreds of patent litigations. In most, if not all of them, a protective order is entered. These invariably cover license terms which I know from experience are highly confidential and sensitive information. It would amount to my admitting to an adversary that our outside counsel and Samsung had violated a protective order protecting the adversary’s information and that I was attempting to use the information gained by such a violation to negotiate license terms. The idea that I would violate a protective order is simply wrong, and the idea that I would tell my adversary that I and my outside counsel had violated it and furthermore were violating it in that very instance by trying to profit from its use is preposterous. I may have used the word 『leak' at the June 4th, 2013 meeting with Nokia , or some other word to reference the idea that all information gets out, though I don't recall the precise phrase I used. I do believe that there may have been some sort of leak due to the contemporaneous media reports outlining the terms of the Apple-Nokia license. But I cannot be certain of this. It has in fact been my own experience that information gets out.  【李寧怡／綜合外電報導】沙烏地阿拉伯是全球唯一不讓女性開車的國家，當地女性爭取駕駛權多年。昨天在首都利雅德，又有逾60名女性刻意違法開車上街，所幸無人被捕。

發起這項運動的團體，呼籲女性自行開車上街，再將開車的影像寄給他們，結果收到共63則影片和手機簡訊。美聯社訪問到一名32歲的女性經濟學者，她說只是開車到雜貨店再回家，已做好坐牢的準備，丈夫和家人都在家裡焦急等候，所幸沒有警察將她攔下。
 沙烏地阿拉伯以極端保守的角度詮釋伊斯蘭教義，雖無明令禁止女性開車，但不發駕照給女性，甚至規定女性外出必須由家中男性親人陪同。近年沙國已逐漸鬆綁對女性的諸多限制，讓她們可參與地方選舉；1990年沙國首次女性開車示威活動中，有50人被捕，也和昨天無人被捕的情況大不相同。不過該國仍規定女性旅行、結婚、接受高等教育等，須有男性親人同意。

【突發中心／新北報導】汐止區工建路昨天深夜10時許，1位太太表示他的老公在家中燒炭，表示已經沒呼吸了，消防局接獲報案救護車趕往現場救援。
 
救護車趕到現場，發現自殺患者已經明顯死亡，死者老婆向警方表示，最近死者有官司纏身，最近心情很低落，可能是因為這個原因才自殺，死者是在浴室內用臉盆燒炭，家人回到家的時候才發現，已經為時已晚，詳細死因還有待警方調查。

鴻海董事長郭台銘今天參加第九屆兩岸經貿文化論壇，面對兩岸服貿協議對中小企業衝擊時表示，政府採取保護措施是暫時性的，要靠自我競爭。如何增加中小企業競爭力，比保護中小企業還重要，關起門來自我感覺良好，不見得是對的。

他表示，他準備結勢，帶中小企業、文創協會等到每個地方去。例如台灣很多中小企業到大陸開店、開廠，大家集合在一起，集合力量，要地自己買來蓋，他正透過兩岸峰會，在做一些努力跟溝通。

郭台銘表示，政府應該思考，如何讓中小企業在台灣保有競爭公平性，能得到在地優勢，到大陸來經商也能得到實質幫助，讓他們實際感受到政府的努力。

【蔡筱雯／綜合外電報導】三星智慧表Galaxy Gear才開賣不久，消費者反應卻不甚理想

科技網站Geek.com取得美國大賣場Best Buy外洩資料顯示，購買Galaxy Gear手表的顧客有3成反悔退貨，原因不詳。科技網站推估，可能是因為Galaxy Gear非得跟三星手機搭配才能順暢運作，其他品牌手機無用武之地；再加上Galaxy Gear跟多種現有的Android應用程式並不相容，因此不得消費者歡心，慘遭退貨。
